Poland's exit tax may violate EU law — ECJ ruling could force overhaul
Poland's exit tax regulations are criticized as overly restrictive, hitting individuals making natural decisions about relocating or pursuing careers abroad, not just those avoiding taxes. The European Court of Justice is expected to rule on whether the rules comply with EU law. Experts say the regulations may require a comprehensive overhaul if found incompatible.
Exit tax to regulacja niedojrzała, w której intencja walki z unikaniem opodatkowania bezpośrednio uderza w osoby podejmujące naturalne decyzje o przeprowadzce czy rozwoju kariery za granicą. Wyrok TSUE zapewne ostatecznie przesądzi, czy polskie przepisy o exit tax są zgodne z prawem unijnym, czy też, jako zbyt restrykcyjne, będą wymagały gruntownej nowelizacji.
